Welcome to Fintara. These Terms of Service (“Terms”) govern your access to and use of our website, platform, and services (collectively, the “Services”). By accessing or using any part of our platform, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Services.

1. Services Provided

Fintara offers tenant screening solutions, including background checks, to landlords, property managers, and other authorized users. Background checks are initiated upon request and rely on information voluntarily submitted by applicants.

Fintara is not a credit bureau, financial institution, or decision-making authority. The results of our reports are intended to assist landlords in making independent leasing decisions. Fintara does not approve or deny rental applications.

2. User Responsibilities

Applicants

You agree to provide accurate and complete information as part of the application and consent process. You acknowledge that submission of false, incomplete, or misleading information may result in an incomplete or inaccurate background report.

Landlords

You are solely responsible for ensuring that your use of screening reports complies with all applicable federal, state, and local laws, including the Fair Credit Reporting Act (FCRA) and any applicable housing or privacy regulations. You must maintain the confidentiality of the screening results and use them only for lawful purposes.

3. Privacy and Data Use

Fintara is committed to protecting user privacy. Personal information submitted through our platform is used exclusively to facilitate the background screening process and to provide necessary communications related to service completion.

We do not sell or share your personal data with third parties for marketing or promotional purposes. All data is stored and transmitted securely in accordance with industry best practices and applicable data protection laws.

4. Payment Terms

All fees for background screening services are paid by the requesting landlord or authorized party at the time of order. Payment is processed through our secure checkout system. Fees are non-refundable once a screening request is submitted.

5. Communications & Consent

By submitting your application or using the Fintara platform, you may receive transactional communications related to your screening process, including reminders or status updates.

Consent Disclosure

By providing your contact information and affirmatively opting in through a designated checkbox or similar mechanism, you consent to receive communications via email or text message, limited strictly to:

  • Confirming application receipt

  • Providing status updates

  • Sending secure links to complete required steps

  • Notifying you of screening results availability

Text messages will never include marketing or promotional content. Consent must be clearly expressed—pre-checked boxes or implied consent are not sufficient.

Message Purpose: Transactional messages only, related to applicant-submitted background screening

Opt-Out: Reply STOP to any message at any time to stop receiving further texts.

Message/Data Rates: Standard messaging and data rates may apply based on your mobile plan.

Fintara does not guarantee message delivery and is not responsible for carrier delays or filtering.

6. Limitation of Liability

Fintara provides Services on an “as-is” and “as-available” basis. We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or accuracy of results.

To the fullest extent permitted by law, Fintara shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from your use of our Services.

7. Changes to Terms

We reserve the right to modify these Terms at any time. Updated terms will be posted on this page and are effective immediately upon posting. Continued use of the Services after changes indicates acceptance of the revised Terms.

8. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of laws principles. Any disputes arising from these Terms or the use of Fintara’s Services will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
